THE MENDING JOURNEY

TERMS OF USE

Effective: 09/01/2026  |  Version: 1.0  |  TheMendingJourney.com

  1. 1. Acceptance and scope. These Terms govern your access to TheMendingJourney.com and any related pages, accounts, forums, or website features that link to them (the "Website"). The Website is operated by The Mending Journey ("Company," "we," or "us"). By accessing or using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website. We may update these Terms by posting a revised version and effective date; continued use after the change means acceptance where permitted by law.
  2. 2. Eligibility, accounts, and privacy. You must be at least 18, or have the consent of a parent or guardian, to create an account or use interactive features. Provide accurate information, protect your credentials, and notify us of suspected unauthorized use. You are responsible for activity through your account. Our collection and use of personal information are described in the Privacy Policy.
  3. 3. Educational content; no medical or therapeutic services. The Website provides general nervous-system education and self-development information only. It does not provide medical or mental-health advice, diagnosis, treatment, psychotherapy, professional care, or crisis services, and no provider-patient relationship is created. Do not delay professional care because of Website content. Use your judgment and consult a qualified licensed professional about your needs. In an emergency call 911; in the United States, call or text 988 for crisis support. Results are not guaranteed, and testimonials are individual experiences rather than promises.
  4. 4. Permitted use and prohibited conduct. We grant you a limited, revocable, nonexclusive, nontransferable right to use the Website for lawful personal, noncommercial purposes. You may not copy, sell, republish, scrape, frame, reverse engineer, bypass access controls, introduce malicious code, overload or disrupt the Website, impersonate others, collect users' information, violate privacy or intellectual-property rights, harass anyone, post unlawful or deceptive material, spam or solicit users, or use automated systems except as we expressly authorize.
  5. 5. Intellectual property and user content. The Website and its text, videos, exercises, graphics, branding, design, software, and other materials are owned by or licensed to the Company and protected by law. No ownership transfers to you. You retain ownership of content you submit, but grant us a worldwide, nonexclusive, royalty-free license to host, reproduce, display, format, and moderate it only as reasonably needed to operate, secure, and improve the Website. You represent that you have the necessary rights. We may remove content or restrict interactive features. Community communications are not guaranteed confidential; share thoughtfully.
  6. 6. Memberships, purchases, and third parties. Paid memberships, subscriptions, programs, and purchases are also governed by the applicable checkout disclosures and Membership Agreement; that agreement controls if it conflicts with these Terms regarding a paid service. Third-party platforms, payment processors, links, or content are governed by their own terms. We do not control or endorse them and are not responsible for their availability, security, content, or practices.
  7. 7. Disclaimers and limitation of liability. THE WEBSITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AND UNINTERRUPTED AVAILABILITY. TO THAT SAME EXTENT, THE COMPANY AND ITS OWNERS, PERSONNEL, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST DATA OR PROFITS, OR HARM ARISING FROM WEBSITE USE, THIRD PARTIES, OR USER CONTENT. OUR TOTAL LIABILITY FOR WEBSITE-RELATED CLAIMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US DIRECTLY FOR WEBSITE ACCESS DURING THE PRECEDING SIX MONTHS. Nothing excludes liability or consumer rights that cannot lawfully be excluded.
  8. 8. Indemnification, suspension, and termination. To the extent permitted by law, you will defend and indemnify the Company and its personnel against third-party claims, losses, and reasonable costs arising from your unlawful conduct, your user content, your infringement of another's rights, or your material breach of these Terms. We may suspend or terminate access, remove content, or change or discontinue Website features for violations, security or legal reasons, or operational needs. Provisions that should logically survive termination will survive.
  9. 9. Pennsylvania law and general terms. Pennsylvania law governs without regard to conflict-of-law rules. Before filing suit, each party will give written notice and try in good faith to resolve the dispute informally for 30 days, except for urgent injunctive or intellectual-property relief. Subject to applicable consumer law, exclusive venue lies in state or federal courts serving Chester County, Pennsylvania. If a provision is unenforceable, it will be limited or severed and the remainder will continue. These Terms, the Privacy Policy, and any applicable Membership Agreement are the entire agreement for their subjects. No waiver is continuing, and headings are only for convenience.
